Substance Abuse and Divorce

One of the marriage difficulties that predictably leads to divorce  is one spouse’s alcohol abuse or other addiction – to gambling, sex, food, drugs or spending. Over time, these habits erode the relationship and wreak havoc on finances.

When a court determines a parenting plan, it must consider the parents’ respective abilities to create an atmosphere free from substance abuse for the children.

If a spouse dissipates marital funds on drugs, gambling or other types of misconduct, that fact may also be considered in the equitable distribution scheme of  the parties assets and liabilities.

Be sure to discuss your particular concerns with your attorney during your initial consult. If you or your spouse are suffering from addictions, those issues should be addressed in the context of the divorce.
